Immigration NZ’s Accredited Employer 3 check system, introduced in 2022, consists of #1 Employer , #2 Job and #3 Migrant .

The system was designed to be easier, faster and promote Kiwi worker hiring while protecting migrants.  However, for employers, the new processes are tricky to navigate around INZ’s changing rules, increased scrutiny of organisation financial stability and structure and ongoing compliance requirements.  Being able to hire who and when you need takes smart planning to avoid declines, delays and unnecessary costs.

Employer Check

Application: through an online declaration form which can be completed directly or by an adviser on your behalf

For year one of the check, since INZ haven’t implemented all the requirements, they generally only require the form (unless financial concerns) but include a declaration to compliance with their new ‘non exploitive’ measures which they will likely checking this year but no doubt audit at renewal.

Overview-

  • Must be a genuine business (INZ requires an NZBN for this)
  • Must be financially viable (specific questions to warrant this)
  • Must commit to other compliance measures that will likely be audited over the year, including settlement packs, online course completion by employers and migrants and employment agreements/pay that match and meet employment and immigration law
Job Check

Application – Employers who have been granted accreditation can submit the job check online including the proof of the genuine 14 labour market test and employment agreement (IEA)

Summary –

This is the traditional labour market test on steroids, with additional requirements and scrutiny. Importantly, it is the link between being allowed to hire a migrant and securing visa approval for one.

  • Pay is the new median wage of $27.76
  • IEAs must match advertising and comply with employment law
  • Advertising must run for 2 weeks and be detailed on job description, candidate requirements, minimum and maximum hours, remuneration and accommodation
  • Limits on acceptable reasons for not hiring Kiwi applicants
Visa Check

How to – Slightly trimmed down requirements for visa with pre-completion of labour test via the Job Check. Remaining are health and character requirements, specific employment agreement, documentation and submission.

Gotchas – Candidate experience, skills, etc must match what was approved in the job check.
